Terms of Service

These Terms of Service ("Terms") govern your use of the Nounly website (nounly.xyz), web application (app.nounly.xyz), and browser extension (collectively, the "Service") operated by Yehor I. ("we", "us", or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old to use Nounly. By using the Service, you represent that you meet this age requirement. If you are between 13 and 18 (or the age of majority in your jurisdiction), you must have permission from a parent or guardian.

2. Account Registration

• You may register using an email address and password, or through Google OAuth.
• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information during registration.
• One person may only maintain one account.
• You must notify us immediately at support@nounly.xyz if you suspect unauthorized access to your account.

3. Use of the Service

3.1 Permitted Use

The Service is provided for personal, non-commercial language learning purposes. You may:

• Create and manage vocabulary dictionaries
• Use training modes to practice vocabulary
• Use the browser extension to capture words from webpages
• Interact with other users through social features
• Use AI-powered features for word analysis and practice

3.2 Prohibited Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to other users' accounts or data
• Upload offensive, harmful, or inappropriate content (including profile pictures and nicknames)
• Use automated scripts, bots, or scrapers to interact with the Service
• Abuse the referral system, XP, coin, or challenge mechanics
• Harass, bully, or intimidate other users
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Resell or redistribute any part of the Service or its content

4. User Content

"User Content" refers to any data you create or upload through the Service, including vocabulary packs, words, translations, profile information, and avatar images.

• You retain ownership of your User Content.
• By making User Content public (e.g., public profile, shared vocabulary packs), you grant us a non-exclusive, worldwide license to display it within the Service for the purpose of operating social and sharing features.
• You are solely responsible for the accuracy and legality of your User Content.
• We may remove User Content that violates these Terms without prior notice.

5. AI-Generated Content

Nounly uses artificial intelligence to provide features such as word analysis, vocabulary pack generation, context-aware translations, and conversational roleplay. Regarding AI-generated content:

• AI outputs are provided for educational purposes only and may contain inaccuracies.
• We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content.
• AI-generated translations and definitions should not be relied upon as professional linguistic or translation services.
• AI roleplay conversations are fictional simulations intended for language practice. Characters and situations are not real.

6. Virtual Currency and In-App Items

The Service includes virtual currency ("Coins") and virtual items (such as streak freezes and profile badges).

• Coins and virtual items have no real-world monetary value and cannot be exchanged for cash, gift cards, or any other form of payment.
• Coins are earned through in-app activities (training, daily goals, challenges) and are not available for purchase.
• We reserve the right to modify the coin economy, item availability, and pricing at any time.
• Virtual items and coins are non-transferable between accounts except where explicitly permitted (e.g., challenges).
• Upon account deletion, all coins and virtual items are permanently lost.

7. Browser Extension

The Nounly browser extension allows you to capture vocabulary from webpages. By using the extension:

• You acknowledge that the extension accesses text content on webpages only when you actively select a word.
• The extension does not collect browsing history, passwords, form data, or any content you do not explicitly select.
• You are responsible for ensuring that capturing content from a particular website does not violate that website's terms of service.

8. Intellectual Property

• The Service, including its design, code, branding, and original content, is the intellectual property of Yehor I. and is protected by applicable copyright and trademark laws.
• The Nounly name, logo, and visual identity are trademarks of Yehor I.
• You may not copy, modify, distribute, or create derivative works based on the Service without explicit written permission.

9. Service Availability

• We aim to provide the Service on a 24/7 basis but do not guarantee uninterrupted access.
• We may modify, suspend, or discontinue any feature of the Service at any time, with or without notice.
• We are not liable for any loss resulting from service downtime or feature changes.

10. Account Termination

• You may delete your account at any time through Profile → Delete Account. This permanently erases all your data.
• We may suspend or terminate your account at our discretion if you violate these Terms, without prior notice.
• Upon termination, your right to access the Service ceases immediately.

11. Limitation of Liability

To the fullest extent permitted by applicable law:

• The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied.
• We do not warrant that the Service will be error-free, secure, or meet your specific requirements.
• In no event shall Yehor I. be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim (if any).

12. Indemnification

You agree to indemnify and hold harmless Yehor I. from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights

13. Governing Law and Disputes

These Terms are governed by the laws of Poland. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Poland.

If you are an EU consumer, you may also be entitled to submit a dispute to the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and revising the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
